General terms & conditions

Range of Application


Patrick A.A. Vanhaute is an attorney-at-law affiliated with the Bar of Antwerp (Belgium) and Luxembourg (Grand Duchy of Luxembourg) and provides his services through the Belgian limited liability company “P. Vanhaute BVBA”.

Unless explicitly agreed otherwise in writing between the parties, the present General Terms & Conditions apply to the liaison between P. Vanhaute BVBA and the client with respect to any legal services conveyed to the client, either in Belgium or in the Grand Duchy of Luxembourg.

Obligation to disclose – Terms


The client undertakes to disclose to the attorney - on his own initiative or at the attorney’s request - all required and useful information and documentation.

The client is liable for all damages or inconveniences that may result from a late, incorrect or incomplete disclosure of information or documents.

In this respect, the client explicitly safeguards the attorney and P. Vanhaute BVBA against any liability.

If the client has, or should have, knowledge of a specific deadline or a significant date, he is obliged to inform the attorney handling the case immediately and disclose all relevant documents and information.

The attorney handling the case keeps watch over all legal deadlines. If a client wishes for a case to be handled within a stipulated time, this should be agreed upon explicitly.

Limitation of liability


Attorneys of P. Vanhaute BVBA have taken out professional liability insurance. Their liability is limited to a maximum of € 1.250.000,00 per claim.

Payment Terms and Conditions


P. Vanhaute BVBA statements of fees and costs must be paid within a 30 days’ notice.

In the event of late payment, interest on arrears, at the applicable statutory rate, will be due without prior reminder or letter of formal notice.

In the event of late payment, a fixed indemnity equal to 10% of the invoiced amount will be due, with a minimum of € 500,00, without prejudice to any indemnity for legal costs which may be deposited in case of legal proceedings.

In case of late payment, P. Vanhaute BVBA reserves the right to suspend its services.

The client will be liable for any damages that may result from said suspension.

Jurisdiction – Applicable law


In case of a dispute between P. Vanhaute BVBA and the client, the Antwerp courts will have exclusive jurisdiction.

P. Vanhaute BVBA reserves the right to bring the client before the courts of his place of residence.

Depending on the territory where the services have been provided, Belgian or Luxembourg law will apply, including the ethical rules that are to be respected by P. Vanhaute BVBA’s attorneys.
